SOKO ONLINE STORE TERMS AND CONDITIONS

§ 1
Preliminary Provisions

  1. The SOKO online store, available at the website address www.sokostudio.pl, is operated by Monika Głębocka conducting a sole proprietorship entered into the Central Register and Information on Economic Activity, registered under NIP: 9571123551, REGON: 385928583; principal place of business: Damroki 40/6 80-177 Gdańsk. The Seller can be contacted via e-mail at: hello@sokostudio.pl.
  2. The Store conducts retail sales of goods within the territory of the Republic of Poland and the countries of the European Union.
  3. These Terms and Conditions are addressed to Consumers using the Store and define the rules for using the online Store as well as the rules and procedures for concluding Distance Sales Agreements with the Customer via the Store.

§ 2
Definitions

  1. Consumer – a natural person entering into an agreement with the Seller within the Store, the subject of which is not directly related to their business or professional activity.
  2. Seller – Monika Głębocka, conducting a sole proprietorship entered into the Central Register and Information on Economic Activity, registered under NIP: 9571123551, REGON: 385928583 principal place of business: ul. Damroki 40/6, 80-177 Gdańsk.
  3. Customer – any entity making purchases through the Store.
  4. Store – the online store operated by the Seller at the internet address www.sokostudio.pl.
  5. Distance Agreement – an agreement concluded with the Customer within an organized system of distance contract conclusion (within the Store), without the simultaneous physical presence of the parties, using exclusively one or more means of distance communication up to and including the time of contract conclusion.
  6. Regulations – these Terms and Conditions of the Store.
  7. Order – a declaration of intent made by the Customer via the Order Form and directly aimed at concluding a Sales Agreement for a Product or Products with the Seller.
  8. Order Form – an interactive form available in the Store that enables placing an Order, in particular by adding Products to the Cart and specifying the terms of the Sales Agreement, including the method of delivery and payment.
  9. Cart – an element of the Store’s software in which the Products selected by the Customer for purchase are visible, and where it is also possible to determine and modify Order data, in particular the quantity of products.
  10. Product – a movable item/service available in the Store that is the subject of a Sales Agreement between the Customer and the Seller.
  11. Sales Agreement – a sales contract for a Product concluded or concluded between the Customer and the Seller via the online Store. The term “Sales Agreement” shall also be understood – depending on the characteristics of the Product – as a service contract or a contract for specific work.

  4. Contact with the Seller is possible exclusively by electronic means. The Store does not provide customer service by telephone.

§ 4
Technical Requirements

  1. To use the Store, including browsing its assortment and placing Orders for Products, the following are required:
    1. a terminal device with Internet access and a web browser,  
    2. an active e-mail account,  
    3. enabled cookies support.

§ 5
General Information

1.  The Seller, to the widest extent permitted by law, shall not be liable for any disruptions including interruptions in the functioning of the Store caused by force majeure, unlawful actions of third parties, or incompatibility of the online Store with the Customer’s technical infrastructure.

  1. Browsing the Store’s assortment does not require creating an Account. Placing Orders by the Customer for Products available in the Store is possible by providing necessary personal and address data enabling the processing of the Order without creating an Account.
  2. Product prices in the Store are given in Polish zlotys (PLN) and euros (EUR) and include taxes. The Customer may select the currency in which payment will be made before placing the Order. The indicated prices do not include delivery costs.
  3. The final (total) amount payable by the Customer consists of the Product price and delivery costs (including transport, shipping, and postal service fees), about which the Customer is informed on the Store’s website during Order placement, including at the time of expressing the intention to be bound by the Sales Agreement.
  4. Where the nature of the subject of the Agreement does not reasonably allow for the prior calculation of the final (total) price, information on how the price will be calculated, as well as on transport, delivery, postal services, and other costs, will be provided in the Product description.
  5. Placing an Order in the online Store requires the Customer to read and accept these Terms and Conditions during the Order process.
  6. The Terms and Conditions constitute an integral part of the sales agreement concluded between the Customer and the Seller.
  7. The Seller enables the sale and delivery of Products within the European Union. Delivery costs and times outside the territory of Poland depend on the country of delivery and are indicated when placing the Order.

§ 6
Order Placement Rules

  1. Orders are accepted via the Store’s website and can be placed 24 hours a day, 7 days a week, all year round, except during periods when the website cannot be displayed due to maintenance breaks or other technical reasons.
  2. An order is valid if the Customer correctly fills out the order form and provides accurate billing and contact details, including the exact shipping address, phone number, and email address.
  3. If the data provided is incomplete, the Seller will contact the Customer via email.
  4. The Seller is not responsible for incorrectly provided data by the Customer, such as the delivery address or a non-existent or incorrect email address.
  5. The Customer agrees to receive an electronic version of billing documents, such as a receipt or invoice, sent to the email address provided.
  6. If the Customer chooses to pay via bank transfer to the Seller’s account, they have 2 business days to complete the payment, counted from the moment they receive an email with the transfer details. After this period, the order will be canceled.
  7. To place an order, the Customer must: 

A. Select the Product to be ordered and click the “Add to cart” button (or equivalent);
B. Fill out the order form by entering the recipient’s details and the delivery address, choose the type of shipment (delivery method), and enter invoice details if different from the recipient’s;
C. Click the “Order and pay” button (or equivalent);
D. Choose one of the available payment methods and, depending on the method, complete the payment within the specified time.

§ 7
Available Delivery and Payment Methods

  1. Delivery costs are borne by the Customer unless otherwise specified by the Seller in the Store.
  2. Free delivery is available for purchases of at least 350 PLN. Free shipping does not include shipping outside Poland.
  3. Product delivery is available within the territory of the Republic of Poland and European Union countries. The Seller does not ship outside the European Union.
  4. The Customer may pay in Polish zloty (PLN) or in euros (EUR), depending on the delivery country and the selected currency in the Store.
  5. Payments in euros are processed via Blue Media S.A., which handles international payments and currency conversions according to the current exchange rate.
  6. The Customer may choose from the following delivery or pickup methods for orders within Poland:
    A. DPD courier delivery – cost: 17,48 PLN, estimated delivery time: 1–2 business days from the moment the parcel with the Order is shipped.
    B. DPD Pickup Point – cost: 11,25 PLN, estimated delivery time: 1–2 business days from the moment the parcel with the Order is shipped.
    C. InPost Parcel Locker pickup – cost: 15,61 PLN, estimated delivery time: 1–2 business days from the moment the parcel with the Order is shipped.
    D. Orlen Paczka pickup – cost: 11,98 PLN, estimated delivery time: 1–2 business days from the moment the parcel with the Order is shipped.
  7. The Customer may choose from the following delivery methods for international orders:
    A. DPD courier delivery to the following countries: Austria, Croatia, Czech Republic, the Netherlands, Lithuania, Latvia, Germany, Portugal, Romania, Slovakia, Slovenia, Hungary – cost: 45,03 PLN, estimated delivery time: 2–6 business days from the moment the parcel with the Order is shipped.
    B. DPD courier delivery to the following countries: Denmark, Belgium, Estonia, France, Greece, Spain, Luxembourg, Bulgaria – cost: 63 PLN, estimated delivery time: 2–6 business days from the moment the parcel with the Order is shipped.
    C. DPD courier delivery to the following countries: Finland, Ireland, Sweden, Italy – cost: 94 PLN, estimated delivery time: 2–6 business days from the moment the parcel with the Order is shipped.
  8. By making a purchase in the Store, the Customer grants the Seller a one-time power of attorney to conclude, on the Customer’s behalf and for the Customer’s benefit, a contract for the provision of shipment/ delivery services with a courier company or postal operator selected by the Seller. This power of attorney covers exclusively the act of dispatching the parcel to the Customer.
  9. The amount charged to the Customer as the delivery cost constitutes solely a reimbursement of the actual shipping expenses incurred on behalf of the Customer, and does not constitute any remuneration for the Seller. The Seller does not add any margin, commission, or other profit-generating component to the delivery cost.
  10. The Seller undertakes to keep documents confirming the cost of the shipping service, such as shipment confirmations or invoices issued by the carrier.
  11. The funds provided by the Customer to cover the delivery cost are of a technical nature and are transferred by the Seller to the carrier acting as a party to the contract concluded on behalf of the Customer.
  12. The Customer may use the following payment methods for their Order:
    a) Autopay fast transfers (PLN)
    b) Blik (PLN)
    c) Google Pay/Apple Pay (PLN)
    d) PayPal payment (PLN or EURO)
    e) Payment cards via PayPal (PLN or EURO) without registration), including:
    – Visa
    – Visa Electron
    – Mastercard
    – Mastercard Electronic
    – Maestro
  13. All payments are processed securely, and payment card data is handled in accordance with applicable security standards.

§ 8
Execution of the Sales Agreement

  1. The Sales Agreement between the Customer and the Seller is concluded after the Customer places an Order via the Order Form on the online Store, in accordance with § 6 of these Terms and Conditions.
  2. Upon placing the Order, the Seller promptly confirms its receipt and simultaneously accepts the Order for processing. Confirmation of receipt and acceptance is provided by the Seller via an email sent to the Customer’s email address provided during the ordering process. This email includes at least the Seller’s statements confirming receipt and acceptance of the Order, as well as confirmation of the conclusion of the Sales Agreement. The Sales Agreement is deemed concluded upon the Customer’s receipt of this email.
  3. Order fulfillment consists of preparing the Order for shipment to the Customer. The Order is considered fulfilled once it is prepared for dispatch.
  4. The Product will be shipped by the Seller within a maximum 5 business days, using the delivery method selected by the Customer during the ordering process.
  5. If the Customer chooses to pay by bank transfer, electronic payment, or payment card, the Product will be shipped within maximum 5 business days from the date the payment is credited to the Seller’s bank account, subject to § 6(6). The delivery time specified in § 7, depending on the selected delivery method, must be added to this period.
  6. Product delivery is available within the territory of the Republic of Poland and European Union countries. Delivery costs outside Poland are calculated individually based on the selected destination country.

§ 9
Right of Withdrawal from the Agreement

  1. A Consumer who has entered into a distance agreement with the Seller may withdraw from the Sales Agreement within 14 calendar days from the date of taking possession of the purchased items, without providing any reason.
  2. The period specified in paragraph 1 begins upon delivery of the Product to the Consumer or a person designated by the Consumer other than the carrier.
  3. For Agreements covering multiple Products delivered separately, in batches, or in parts, the period specified in paragraph 1 begins upon delivery of the last item, batch, or part.
  4. The Consumer may withdraw from the Agreement by submitting a statement of withdrawal to the Seller. To meet the withdrawal deadline, it is sufficient for the Consumer to send the statement before the deadline expires.
  5. The statement may be sent by traditional mail or electronically to the Seller’s email address—contact details are provided in § 3. The statement may also be submitted using the form attached as Appendix 2 to these Terms and Conditions and to the Consumer Rights Act of May 30, 2014, although this is not mandatory.
  6. If the Consumer submits the statement electronically, the Seller will promptly send confirmation of receipt to the email address provided by the Consumer.
  7. Effects of withdrawal from the Agreement:
    A. Upon withdrawal from a distance Agreement, the Agreement is considered null and void.
    B. Upon withdrawal, the Seller shall promptly, and no later than within 14 calendar days from the date of receiving the returned Product, refund all payments made by the Consumer, including delivery costs, except for additional costs resulting from the Consumer’s choice of a delivery method other than the least expensive standard delivery offered by the Seller.
    C. The refund will be made using the same payment method used by the Consumer in the original transaction, unless the Consumer expressly agrees to a different method that does not incur any costs.
    D. The Consumer must return the Product to the following address: Piastowska 100D/89 80-358 Gdańsk hello@sokostudio.pl 512748403 (or Parcel Locker InPost GDA49N, ul. Prezydenta Lecha Kaczyńskiego 7, or Parcel Machine Orlen Paczka ul. Piastowska 98 80-352 Gdańsk), promptly and no later than 14 days from the date of informing the Seller about the withdrawal. The deadline is met if the Product is sent before the 14-day period expires.
    E. The Consumer bears the direct cost of returning the Product.
    F. The Consumer is liable only for any diminished value of the Product resulting from handling it in a manner other than necessary to determine its nature, characteristics, and functionality.
  8. The right to withdraw from a distance Agreement does not apply to the Consumer in relation to Agreements:
    A. for non-prefabricated items made to the Consumer’s specifications or personalized to meet their individual needs;
    B. for items delivered in sealed packaging that cannot be returned after opening due to health protection or hygiene reasons, if the packaging was opened after delivery;
    C. for items that deteriorate rapidly or have a short shelf life;
    D. for services fully performed by the Seller with the Consumer’s express consent, who was informed prior to performance that they would lose the right to withdraw once the service was completed;
    E. where the price or remuneration depends on fluctuations in the financial market beyond the Seller’s control, which may occur before the withdrawal deadline;
     F. for items that, after delivery, are inseparably combined with other items due to their nature;
    G. for alcoholic beverages whose price was agreed upon at the time of the Sales Agreement, and whose delivery may occur only after 30 days, and whose value depends on market fluctuations beyond the Seller’s control;
    H. for sealed audio or video recordings or computer software, if the packaging was opened after delivery;
    I. for the delivery of newspapers, periodicals, or magazines, except for subscription agreements;
    J. for the delivery of digital content not stored on a tangible medium, if performance began with the Consumer’s express consent before the withdrawal deadline and after being informed by the Seller of the loss of the right to withdraw.

§ 10
Complaints and Warranty

  1. The Sales Agreement covers new Products or new Products made from second-hand materials (in such cases, this information is included in the Product description).
  2. If a defect is found in the purchased item—one that the Customer was not informed about—the Customer has the right to file a complaint based on the warranty provisions of the Civil Code.
  3. Complaints should be submitted in writing or electronically to the Seller’s contact addresses provided in these Terms and Conditions. A complaint form template is available on the Store’s website.
  4. It is recommended that the complaint include a brief description of the defect, the circumstances (including the date) of its occurrence, the Customer’s contact details, and the Customer’s request regarding the defect.
  5. The Seller will respond to the complaint promptly, no later than within 14 days. If the Seller fails to respond within this period, the complaint is deemed accepted.

§ 11
Out-of-Court Complaint Handling and Redress Procedures

  1. Detailed information regarding the Consumer’s ability to use out-of-court complaint handling and redress procedures, as well as the rules for accessing these procedures, is available at the offices and websites of district (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, the Provincial Inspectorates of the Trade Inspection, and at the following website of the Office of Competition and Consumer Protection: https://uokik.gov.pl/pomoc-dla-konsumentow 
  2. The Consumer has the following exemplary options for using out-of-court complaint handling and redress procedures:
    A. The Consumer is entitled to apply to a permanent consumer arbitration court, as referred to in Article 37 of the Act of 15 December 2000 on the Trade Inspection (Journal of Laws of 2014, item 148, as amended), with a request to resolve a dispute arising from the Agreement concluded with the Seller.
    B. The Consumer is entitled to apply to the provincial inspector of the Trade Inspection, in accordance with Article 36 of the Act of 15 December 2000 on the Trade Inspection (Journal of Laws of 2014, item 148, as amended), with a request to initiate mediation proceedings to amicably resolve a dispute between the Consumer and the Seller.
    C. The Consumer may also obtain free assistance in resolving a dispute with the Seller by contacting a district (municipal) consumer ombudsman or a social organization whose statutory tasks include consumer protection (e.g., the Consumer Federation, the Polish Consumers Association).

§ 12
Personal Data in the Online Store

  1. The administrator of Customers’ personal data collected via the Online Store is the Seller.
  2. Customers’ personal data collected by the administrator via the Online Store is used for the purpose of executing the Sales Agreement, and—if the Customer consents—for marketing purposes.
  3. Recipients of the Customers’ personal data may include:
    A. In the case of a Customer who uses postal or courier delivery, the Administrator provides the collected personal data to the selected carrier or intermediary responsible for delivering the shipment on behalf of the Administrator.
    B. In the case of a Customer who uses electronic or card payment methods, the Administrator provides the collected personal data to the selected entity handling such payments in the Online Store.
  4. The Customer has the right to access and correct their personal data.
  5. Providing personal data is voluntary; however, failure to provide the data required by the Terms and Conditions to conclude the Sales Agreement will result in the inability to conclude the Agreement.

§ 13
Final Provisions

  1. Agreements concluded via the Online Store are made in Polish or English, depending on the Customer’s choice.
  2. For Customers outside of Poland, Polish law and the jurisdiction of Polish courts shall apply.
  3. The Seller reserves the right to amend the Terms and Conditions for valid reasons (e.g., changes in legislation, payment or delivery methods). The Seller will inform the Customer of any changes at least 7 days in advance.
  4. These Terms and Conditions are effective as of 05.12.2025r.
